The 2026 Dr. Pepper® West Jarrin Foundation Sweepstakes

1. Eligibility/Participation: The 2026 Dr. Pepper® West Jarrin QR Code Sweepstakes (the “ Sweepstakes ”) is open only to legal U.S. residents currently residing in select Southern California Counties: Los Angeles, San Bernardino, Riverside, Orange or Clark County, NV (“Eligibility Area”) who are at least eighteen (18) years of age or older as of the date of their entry (an “Entrant”). Employees, directors and officers of Dr Pepper/Seven Up, Inc. (“ Sponsor ”), Amp Activate c/o Upshot LLC (“ Administrator ”), and any of their respective affiliates, parents, subsidiary companies, and advertising and promotion agencies (collectively, the “ Released Parties ”), and members of the immediate families (spouses, parents, children, step children, siblings, step siblings, and their respective spouses, regardless of where they reside), and/or those living in the same household, of any of the foregoing, are not eligible to participate in the Sweepstakes. Void outside the Eligibility Area and where prohibited or otherwise restricted by law. The Sweepstakes is subject to all applicable federal, state, and local laws and is void where prohibited by law. By participating in the Sweepstakes, you agree that: (1) you have read and understand the Official Rules; (2) you meet the Sweepstakes eligibility requirements as set forth in the Official Rules; (3) you accept and agree to be bound by these Official Rules, to Sponsor's Conditions of Use located at https://www.keurigdrpepper.com/en/term-of-use ; Legal Notices and Privacy Policy as published at https://www.keurig.com/content/privacy-policy ; and (4) you unconditionally accept and agree to comply with and abide by the decisions of Sponsor and Administrator, whose decisions shall be final and binding in all respects. No purchase necessary to enter or win this Sweepstakes.

2. Sweepstakes Period: The Sweepstakes begins at 12:00:00 AM Eastern Time (“ET”) on 8/1/26 and ends at 11:59:59 PM ET on 9/30/26 the (“Sweepstakes Period”).

3. How to Enter : During the Sweepstakes Period, visit drpeppersaweeps.com/jarrin (“The “Sweepstakes Site”) or scan the QR code which can be found on promotional material. The code will take you to the Sweepstakes Site where you will complete the information requested on the entry form to enter. There is a limit of one (1) entry (“Entry”) per person per day throughout the entire Sweepstakes Period. No incomplete or automated Entries will be accepted. Multiple Entrants are not permitted to share the same email address. Incomplete Entries, Entries generated by script, macro or other automated means, or Entries that do not fully comply with these Official Rules, or Entries which subvert the Entry process shall be ineligible, at the Sponsor’s sole discretion. Proof of submission of Entry does not constitute proof of delivery or entry during the Sweepstakes Period. All entries become the exclusive property of Sponsor and will not be acknowledged. In the event of any dispute concerning the identity of any Entrant, the relevant entry will be deemed submitted by the authorized account holder of the email address associated with the Entry and such individual must comply with these Official Rules. To participate in this Sweepstakes, each Entrant will be subject to Sponsor’s Terms of Use ( https://www.keurigdrpepper.com/en/term-of-use ) and Privacy Policy https://www.keurig.com/content/privacy-policy ) where applicable.

4. Winner Determination/Prize/Approximate Retail Value (“ ARV”): On or about two (2) business days after the Sweepstakes Period has ended, Administrator, an independent judging agency, shall perform a random Prize Drawing from among all eligible Entries received (“Prize Drawing”), to select twenty three (23) potential Grand Prize Winner (“Grand Prize Winner”). Once confirmed, as detailed below, each of the Grand Prize Winners will receive one (1) twenty three hundred dollar ($2,300.00) tuition award. The total ARV of prizes being given away during the sweepstakes period is twenty-three thousand dollars (ARV: $23,000.00). Limit one (1) prize per winner.

5. Tuition/Educational Awards are payable as follows:

(a) As undergraduate or graduate level tuition at an accredited two-year or four-year college, university, or vocational-technical/trade school (“Eligible Institution”) to cover “Eligible Costs” defined as tuition, fees, books, supplies, equipment, related educational expenses and on-campus room and board to be awarded in the form of a check distributed to the Eligible Institution (eligible under Title IV of the Higher Education Act of 1965 as amended) and located in the United States on behalf of the Prize Winner or a single Designee, who must be at least 17 years of age or older and a legal U.S. resident;

(b) To pay off student loans incurred for Eligible Costs in the form of a check distributed to the loan servicing company on behalf of the Prize Winner or a single Designee; or

(c) A combination of Sections 9 (a) and (b) in an amount not to exceed the Tuition Award amount.

All Tuition Awards will be administered by Scholarship America, Inc. (“Scholarship America”), and are subject to the following and all other terms of these Official Rules. Tuition Awards are to be used to pay current Eligible Costs, student loans incurred in a previous academic year(s) for Eligible Costs, or a combination not to exceed the Tuition Award amount. Checks for the full amount will be sent to the Eligible Institution designated by the Prize Winners or their Designees. Payments applied to educational loans will be payable to the loan servicing company for the Prize Winner or their Designee. (Tuition Awards may be considered taxable and Form 1099-Miscellaneous Income will be issued).

The Tuition Awards must be used for current educational expenses until the expiration date of December 31, 2026 (the “Expiration Date”) or until a degree is earned, whichever occurs first. Following completion of a degree program, the Prize Winner may opt to continue to pursue another degree level until the award expires, is used up, or use toward existing education loans.

Upon notification as a Prize Winner, he or she must notify Scholarship America of their intent to gift the Tuition Award to a single Designee. Scholarship America will set aside the funds until such time as the Designee notifies Scholarship America that the Designee is ready to use the funds for Eligible Costs or student loans. Any Tuition Award not used by the Expiration Date, whether for the Prize Winner or Designee, will be forfeited and returned to Sponsor. The Tuition Award proceeds shall be transferred one (1) time only to a single Designee. The Prize Winner must supply the following identifying information about the Designee to Scholarship America: name, phone number, age, relationship, and postsecondary school information (if known at such time) or the contact information for the loan servicing company. Scholarship America shall not transfer the Tuition Award to an eligible institution or loan servicing company on behalf of the Designee until such time as the identifying information is verified by the Designee and to the satisfaction of Scholarship America. The Prize Winner shall be responsible for completing and filing the required gift tax forms with the Internal Revenue Service. There may be a tax liability to the Prize Winner, and the Prize Winner should consult with a tax expert before accepting the Tuition Award. An IRS Form 1099 will be issued to the Prize Winner. Any tax liability will be the responsibility of the Prize Winner.

In no event will Sponsor be responsible for awarding more than the stated number of Tuition Awards herein. No transfer, substitution, or cash equivalent for any Tuition Awards, in whole or in part, will be permitted, except at Sponsor's sole discretion due to unavailability for any reason, and only then for a prize of greater or equal value determined solely by Sponsor shall be allowed. The decisions of Administrator and Sponsor are final and binding on all matters relating to this Contest. Prizes are awarded “as is” with no warranty or guarantee, either express or implied. All taxes, if any, are each the responsibility of Prize Winner, their Designee, or the Prize Winner’s or Designee’s selected, Eligible Institution or loan servicing company (valued at more than $599). All prize details are at Sponsor’s sole discretion.

The decisions of Administrator and Sponsor are final and binding on all matters relating to this Promotions. Odds of winning a Prize are dependent upon the total number of eligible Entries received throughout the Promotion Period. In no event will Sponsor be responsible for awarding more than the stated Prizes herein. Prize conditions may be added or modified by companies providing those portions of the Prize. The Prize restrictions/conditions stated herein are not all-inclusive. No transfer, substitution, or cash equivalent for a Prize, in whole or in part, will be permitted, except at Sponsor’s sole discretion due to Prize unavailability for any reason, and only then for a prize of greater or equal value determined by Sponsor shall be allowed. There is a limit of one (1) Prize per person, for the entire Promotion.

6. Prize Winner Notification/Verification: The Released Parties are not responsible if the Sweepstakes cannot take place as planned for any reason and accept no liability whatsoever if the Sweepstakes is canceled, delayed, rescheduled, postponed, or otherwise impacted in any way. The potential Prize Winners will be notified via email to the email address or phone number (if available) provided, on or about one (1) business day after the Prize Drawing. Administrator will make two (2) attempts to contact each potential Prize Winner via such method. Potential Prize Winner will have one (1) business days from the time of the first notification attempt to respond to Administrator or potential Prize Winner will be disqualified and Administrator will select/notify an alternate potential Prize Winner based on a random drawing. If in any instance, notification attempt(s) for the potential Prize Winner fails for any reason, or if a potential Prize Winner is found to have not complied with these Official Rules, fails to return any of the requested documents within the timeframe provided, or cannot accept the Prize for any reason, or cannot accept the Prize for any reason, the applicable Prize will be forfeited and an alternate potential Prize Winner will be selected in a random drawing from among remaining eligible Entries for the applicable drawing, if any. By accepting a Prize in the Sweepstakes, all potential/confirmed Prize Winner hereby consent to the use by the Sponsor of their Entry and all information contained therein including but not limited to, name, likeness, opinions, images, statements and/or other indicia of persona, and personally-identifiable information (collectively “Likeness”), for any and all uses and purposes (including, without limitation, for purposes of advertising and trade) in any media now known or hereinafter developed in any manner throughout the world (including, without limitation, the World Wide Web and on-air) in perpetuity without additional consideration (where legal), consent or prior review, and upon request will provide written consent to such use. All decisions of Sponsor/Administrator relating to the Sweepstakes and drawings are final.

7. Publicity Grant: Acceptance of a Prize constitutes permission for the Sponsor and its designees to use the name, account information, email, or actual or simulated likeness, biographical information, city, state, opinions, and Prize information of the Prize winner in connection with the Sweepstakes and the marketing thereof (including, without limitation, for advertising and Sweepstakes purposes), in perpetuity, throughout the universe, in all media, without additional compensation, notification or permission, unless prohibited by law. Further, each Prize Winner hereby indemnifies the Released Parties from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from breach of these Official Rules or Prizes.

8. General Terms/Limitation of Liability: Noncompliance with any of these Official Rules may result in disqualification. ANY VIOLATION OF THESE OFFICIAL RULES BY ENTRANTS OR WINNERS OR ANY BEHAVIOR BY A WINNER THAT WILL BRING SUCH WINNER OR SPONSOR INTO DISREPUTE (IN SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH PRIZE WINNER’S DISQUALIFICATION FROM THE SWEEPSTAKES AND FORFEITURE OF ANY PRIZE. Released Parties assume no responsibility for incorrect or inaccurate Entry information whether caused by any of the equipment or programming associated with or utilized in this Sweepstakes or by any human error, which may occur in the processing of the Entries in this Sweepstakes. Released Parties are not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or other services, or providers, computer equipment, software, failure of any email due to technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including, without limitation, any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Sweepstakes or for other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of Entries, the announcement of the Prizes, fulfillment of Prizes, or in any Sweepstakes-related materials. All interpretations of these Official Rules and decisions by Sponsor are final. No software-generated, robotic, programmed, script, macro or other automated Entries are permitted. Sponsor, in its sole discretion, reserves the right to disqualify any individual (and void all associated Entries) it suspects or finds: (i) to have used a software-generated, robotic, programmed, script, macro or other automated means of Entry or any other means to subvert the Entry process; (ii) to have tampered with the Entry process or the operation of this Sweepstakes; (iii) to be acting in violation of these Official Rules; (iv) to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person; or (v) to have provided inaccurate information on any legal documents submitted in connection with this Sweepstakes. CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR APPLICATION ASSOCIATED WITH THIS SWEEPSTAKES OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, RELEASED PARTIES RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Entrants agree that the Released Parties (a) shall not be responsible or liable for, and hereby release the Released Parties from, any claims, losses, damages or injuries of any kind (including death) resulting, in whole or in part, directly or indirectly, from participation in the Sweepstakes or any Sweepstakes-related activity, or from acceptance, receipt, possession and/or use/misuse or inability to use the Prize, and (b) have not made any warranty, representation or guarantee, express or implied, in fact or in law, with respect to the Prize, including, without limitation, to such Prize’s quality or fitness for a particular purpose. Released Parties shall not be liable for any injury, damage, loss, expense, accident, delay, inconvenience or irregularity that may be caused or contributed to (1) by any wrongful, negligent or unauthorized act or omission on the part of any of their agents, servants, employees or independent contractors; (2) by any wrongful, negligent or unauthorized act or omission on the part of any other person or entity not an employee of the Released Parties; or (3) by any other cause, condition or event whatsoever beyond the control of the Released Parties. Failure of Sponsor to enforce any provision herein shall not be deemed a waiver of such. Each Entrant agrees to indemnify, defend and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorneys’ fees) arising out of or relating to an Entrant’s participation in the Sweepstakes and/or Entrant’s acceptance, use or misuse of Prize. Sponsor reserves the right, in its sole discretion, to modify these rules for the purposes of fulfilling the intent of the Sweepstakes. If, for any reason, the Sweepstakes is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor, in its sole discretion, reserves the right to cancel, terminate, modify or suspend the Sweepstakes. Should the Sweepstakes be terminated prior to the stated expiration date, notice will be posted where Sponsor deems fit and the Prizes will be awarded via random drawings from among all eligible Entries received for each drawing up until the time of termination, or in a manner that is fair and equitable as determined by Sponsor. In such event, Sponsor reserves the right to award the Prizes at random from among the eligible Entries received throughout the Sweepstakes Period and overall, up to the time of the impairment. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If any part of these Official Rules is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty and liability disclaimers set forth herein, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and these Official Rules shall continue in effect. UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANTS HEREBY WAIVE ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, SPECIAL, INDIRECT, OR ANY OTHER DAMAGES WHATSOEVER. IN NO EVENT SHALL RELEASED PARTIES BE LIABLE TO ANY ENTRANT OR PRIZE WINNER FOR DAMAGES THAT EXCEED THE VALUE OF THE PRIZES TO BE AWARDED TO AN INDIVIDUAL ENTRANT IN THIS SWEEPSTAKES.

9. Governing Law/Venue : THE SWEEPSTAKES IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF TEXAS, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN TEXAS. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF. THE RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED IN PROMOTIONAL LAW AND LICENSED TO PRACTICE LAW IN TEXAS. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN COLLIN COUNTY TEXAS. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, SPECIAL, INDIRECT, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEYS’ FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF. ENTRANTS AGREE THAT ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS PROMOTION SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION.

Una vez confirmado, como se detalla a continuación, cada uno de los Ganadores del gran premio recibirá un (1) premio de matrícula de dos mil trescientos dólares ($2,300.00). El VAVP total de los premios que se otorgarán durante el período del sorteo es de veintitrés mil dólares (VAVP: $23,000.00). El límite es de un (1) premio por ganador.

5. Los premios de matrícula/educación se pagan de la siguiente manera:

(a) en concepto de matrícula de grado o posgrado en un centro acreditado de enseñanza superior de dos o cuatro años, universidad o escuela de enseñanza vocacional, técnica o comercial (“Institución elegible”) para cubrir los “Costos elegibles” definidos como matrícula, tasas, libros, suministros, equipamiento, gastos educativos relacionados y alojamiento y comidas en el campus que se otorgarán en forma de cheque distribuido a la Institución elegible (elegible según el Título IV de la Ley de Educación Superior de 1965 y sus enmiendas) y ubicada en los Estados Unidos en nombre del Ganador del premio o de una única Persona designada, que debe tener al menos 17 años de edad o más y ser residente legal de los Estados Unidos;

(b) para pagar los préstamos estudiantiles contraídos para los Costos elegibles en forma de un cheque distribuido a la empresa de gestión de préstamos a nombre del Ganador del premio o de una única Persona designada; o

(c) una combinación de las Secciones 9 (a) y (b) por un monto que no exceda el monto del Premio de matrícula.

Todos los Premios de matrícula serán administrados por Scholarship America, Inc. (“Scholarship America”) y están sujetos a los siguientes y todos los demás términos de estas Normas oficiales. Los Premios de matrícula se utilizarán para pagar los Costos elegibles actuales, los préstamos estudiantiles contraídos en uno o varios años académicos anteriores para los Costos elegibles, o una combinación, sin exceder el monto del Premio de matrícula. Los cheques por el monto total se enviarán a la Institución elegible designada por los Ganadores del premio o sus Personas designadas. Los pagos aplicados a los préstamos educativos se abonarán a la empresa de gestión de préstamos del Ganador del premio o de su Persona designada. (Los Premios de matrícula pueden considerarse imponibles y se emitirá el Formulario 1099: Ingresos varios).

Los Premios de matrícula deben utilizarse para gastos educativos actuales hasta la fecha de vencimiento del 31 de diciembre de 2026 (la “Fecha de vencimiento”) o hasta que se obtenga un título, lo que ocurra primero. Al finalizar un programa de estudios, el Ganador del premio puede optar por seguir estudiando otro nivel de estudios hasta que el premio venza, se agote o se utilice para los préstamos educativos existentes.

Al ser notificado como Ganador del premio, deberá notificar a Scholarship America su intención de otorgar el Premio de matrícula a una única Persona designada. Scholarship America apartará los fondos hasta el momento en que la Persona designada notifique a Scholarship America que está listo para usarlos para los Costos elegibles o préstamos estudiantiles. Todo Premio de matrícula que no se utilice antes de la Fecha de vencimiento, ya sea para el Ganador del premio o la Persona designada, se perderá y se devolverá al Patrocinador. El dinero del Premio de matrícula se transferirá una (1) sola vez a una única Persona designada. El Ganador del premio deberá proporcionar a Scholarship America la siguiente información de identificación sobre la Persona designada: nombre, número de teléfono, edad, relación e información sobre la escuela de educación superior (si se conoce en ese momento) o la información de contacto de la empresa de gestión de préstamos. Scholarship America no transferirá el Premio de matrícula a una institución o empresa de gestión de préstamos elegible en nombre de la Persona designada hasta el momento en que la información de identificación sea verificada por la Persona designada y a satisfacción de Scholarship America. El Ganador del premio será responsable de completar y presentar los formularios requeridos para el impuesto sobre donaciones ante el Servicio de Impuestos Internos (IRS). Puede existir una responsabilidad impositiva para el Ganador del premio, por lo que el Ganador del premio deberá consultar con un asesor fiscal antes de aceptar el Premio de matrícula. Se emitirá un Formulario 1099 del IRS al Ganador del premio. Cualquier responsabilidad impositiva correrá a cargo del Ganador del premio.

En ningún caso el Patrocinador será responsable de otorgar más Premios de matrícula que los indicados en este documento. No se permitirá ninguna transferencia, sustitución o equivalente en efectivo de ningún Premio de matrícula, total o parcialmente, excepto a exclusivo criterio del Patrocinador debido a la indisponibilidad por cualquier motivo y solo entonces se permitirá un premio de mayor o igual valor determinado exclusivamente por el Patrocinador. Las decisiones del Administrador y del Patrocinador son definitivas y vinculantes en todos los asuntos relacionados con este Concurso. Los premios se otorgan “tal como están” sin ninguna garantía expresa o implícita. Todos los impuestos, si los hubiera, correrán a cargo del Ganador del premio, de la Persona designada o de la Institución o empresa de gestión de préstamos elegida por el Ganador del premio o la Persona designada (valorada en más de $599). Todos los detalles del premio quedan a exclusivo criterio del Patrocinador.

Las decisiones del Administrador y del Patrocinador son definitivas y vinculantes en todos los asuntos relacionados con esta Promoción. Las probabilidades de ganar un Premio dependen del número total de Entradas elegibles recibidas durante el Período de la promoción. En ningún caso el Patrocinador será responsable de otorgar más Premios que los indicados en este documento. Las empresas que proporcionen esas partes del Premio podrán agregar condiciones de dicho Premio o modificarlas. Las restricciones/condiciones del Premio establecidas en este documento no son exhaustivas. No se permitirá ninguna transferencia, sustitución o equivalente en efectivo de ningún Premio, total o parcialmente, excepto a exclusivo criterio del Patrocinador debido a la indisponibilidad del Premio por cualquier motivo y solo entonces se permitirá un premio de mayor o igual valor determinado por el Patrocinador. Hay un límite de un (1) Premio por persona, para toda la Promoción.

6. Notificación/verificación del ganador del Premio: las Partes exentas no son responsables si el Sorteo no puede realizarse según lo previsto por cualquier motivo y no aceptan responsabilidad alguna si el Sorteo se cancela, retrasa, reprograma, pospone o se ve afectado de cualquier otro modo. Se notificará a los posibles Ganadores del Premio a través de la dirección de correo electrónico o el número de teléfono (si corresponde) proporcionados, aproximadamente un (1) día hábil después del Sorteo del Premio. El Administrador realizará dos (2) intentos de contacto con cada posible ganador del Premio a través de dicho método. El posible ganador del Premio tendrá un (1) día hábil desde el primer intento de notificación para responder al Administrador o serán descalificados y el Administrador seleccionará/notificará a un posible ganador alternativo del premio mediante un sorteo aleatorio. Si, en cualquier caso, los intentos de notificación al posible Ganador del Premio no se concretan por algún motivo, o si se descubre que un posible Ganador del Premio no ha cumplido con estas Normas oficiales, no devuelve alguno de los documentos solicitados en el plazo establecido o no puede aceptar el Premio por cualquier motivo, el Premio correspondiente se anulará, y se seleccionará un posible Ganador del Premio alternativo en un sorteo al azar de entre las Entradas elegibles restantes para ese sorteo, si las hubiera. Al aceptar un Premio del Sorteo, todos los Ganadores posibles/confirmados consienten, en virtud de las presentes, que el Patrocinador utilice su Entrada y toda la información contenida en esta, incluidos, entre otros, el nombre, la imagen, las opiniones, las imágenes, las declaraciones u otros indicios de la persona, y la información personal identificable (colectivamente, “Imagen”), para todos y cada uno de los usos y fines (incluidos, entre otros, los fines publicitarios y comerciales), en cualquier medio de comunicación conocido actualmente o que se desarrolle en el futuro de cualquier forma en todo el mundo (lo que comprende, entre otros, en Internet y al aire) ahora o en el futuro sin consideración adicional (donde sea legal), consentimiento o revisión previa, y, previa solicitud, proporcionarán consentimiento por escrito para dicho uso. 7. Concesión de publicidad: la aceptación de un Premio constituye el permiso para que el Patrocinador y sus designados utilicen el nombre, la cuenta, la información, el correo electrónico o la imagen real o simulada, la información biográfica, la ciudad, el estado, las opiniones y la información del Ganador del Premio que guarden relación con el Sorteo y la mercadotecnia que de allí se desprenda (lo que incluye, entre otros, para fines publicitarios y del Sorteo ), ahora o en el futuro, en todo el mundo, en todos los medios de comunicación, sin consideración adicional, notificación ni permiso, a menos que se prohíba por ley. Además, por el presente, cada Ganador del premio exime a las Partes exentas de cualquier reclamo, daño, responsabilidad y gasto (incluidos los honorarios legales razonables) que surjan del incumplimiento de estas Normas oficiales o de los Premios.

8. Términos generales/limitación de responsabilidad: el incumplimiento de cualquiera de estas Normas oficiales puede dar como resultado la descalificación. CUALQUIER VIOLACIÓN DE ESTAS NORMAS OFICIALES POR PARTE DE LOS PARTICIPANTES O GANADORES O CUALQUIER COMPORTAMIENTO POR PARTE DE UN GANADOR QUE DESPRESTIGIE A DICHO GANADOR O AL PATROCINADOR (A EXCLUSIVO CRITERIO DEL PATROCINADOR) TENDRÁ COMO CONSECUENCIA LA DESCALIFICACIÓN DE DICHO GANADOR DEL SORTEO Y LA ANULACIÓN DE CUALQUIER PREMIO. Todas las interpretaciones de estas Normas oficiales y las decisiones del Patrocinador son definitivas. No se permiten Entradas generadas por software, robots, programas, scripts, macros u otros medios automáticos. El incumplimiento del Patrocinador de hacer cumplir cualquier disposición del presente no representará una renuncia a dicho derecho. Cada Participante acepta exonerar, defender y eximir de responsabilidad a las Partes exentas de reclamaciones, gastos y responsabilidades de toda índole (lo que incluye los honorarios de abogados razonables) que surjan de la participación del Participante en el Sorteo y/o de su aceptación, uso o uso indebido del Premio o que guarden relación con estos. El Patrocinador se reserva el derecho, a su discreción exclusiva, de modificar estas normas con el fin de cumplir con la intención del sorteo. Si, por algún motivo, el Sorteo no puede ejecutarse según lo planeado, lo que incluye, entre otros, infección por virus informáticos, errores, manipulación, intervención no autorizada, fraude, fallas técnicas o cualquier otra causa fuera del control del Patrocinador que corrompa o afecte la administración, seguridad, equidad, integridad o conducta adecuada de este Sorteo, dicho Patrocinador, a su exclusivo criterio, se reserva el derecho de cancelar, terminar, modificar o suspender el Sorteo.
